#Transferred to a scammer
Prepare chat screenshots / transfer slip / account information / full name or any evidence of the scammer. #Print them out too.
Go to the police station and file a report for “fraud.”
Recommended to write a statement in advance, listing the sequence of events in simple language so you don’t have to explain to the officer sentence by sentence.
You will get the daily report and the "Tor Chor" (T.C.) document.
.
The T.C. document is very important because it is the order that the police can use to instruct the bank. With only the daily report, the bank cannot do anything to the account owner.
.
The T.C. document content orders to freeze the scammer’s account first.
Take the T.C. document to the scammer’s bank to request the freeze.
.
Next are the bank steps.
The branch sends it to HQ to freeze the scammer’s account.
The bank tries to contact the scammer.
If the bank cannot contact them (if they can, that’s strange), the scammer’s bank will inform your bank (if different banks) that they’ve processed it but cannot reach the scammer.
Take the original T.C. document back to the police station.
Notify the officer (must be the same one handling your case) about the case progress and request a summons.
The police will issue two summonses (about 10 days apart).
If they don’t show up after two summonses, the police will issue an arrest warrant.
The police will bring the scammer to the police station where you filed the report to mediate.
14.1 If they agree to return the money… case closed.
14.2 If they don’t have money… they go to jail.
.
.
.
Going to jail will give them a criminal record and make life harder.
Usually, scammers choose to return the money.
But if the scammer really has no money,
they must accept going to jail.
(If they go to jail, you still won’t get your money back.)
.
From inquiry,
how much damage each day in jail compensates is still unclear.
For example, if they scam 1,000 baht, how many days?
If they scam 10,000 baht, how many days?

#Transferred to the wrong account
Bring your ID card to your bank branch (your bank).
The bank will contact the recipient (if different banks, they’ll forward to the other bank first).
2.1 If they can be contacted and agree to return… case closed.
2.2 If they can’t be contacted,
this is the tricky part.
Because usually the police don’t want to issue a T.C. document.
Because issuing a T.C.
means the recipient had fraudulent intent from the start.
But in this case, you transferred by mistake
and they didn’t know (just unreachable).
.
Requesting the police to issue a T.C.
they will be very cautious.
Because it’s like forcing a fraud accusation
on someone who may not know.
.
(The T.C. request process is the same as for a scam transfer.)
But if you are ruthless enough,
you can file for fraud so the bank freezes the account
and wait for the recipient to contact back.
But if they pursue legal action,
they can sue you back as well.
.
Just this topic,
I already have 12 cases.
I’m so tired.
