Royal Gazette Unlocks Phuket! Construction on Mountains and Hills Now Allowed!

The Royal Gazette has issued a new environmental protection regulation for Phuket, replacing the previous version. The new announcement relaxes restrictions on areas above 80-140 meters in elevation and foothill areas, allowing the construction of single houses or standalone buildings under specified conditions.

Key Highlights of the Announcement:

  • Adjustment of Protected Areas
    The number of designated protected zones has been reduced from 9 to 8.

  • New Measures for Environmental Conservation
    Regulations have been introduced to prevent and mitigate environmental impacts from building construction and factory development. These include:

    • Requirements for factories to install machinery and equipment for pollution control.

    • Measures for permeable land surfaces to support water absorption.

    • Tree planting and green space allocation as part of new developments.

  • Eliminating Redundant Regulations
    Certain redundant measures, previously overlapping with existing laws, have been removed.

  • Relaxation of Building Height Restrictions
    Height regulations for some construction projects have been adjusted to align with building control laws and urban planning regulations, facilitating future expansion.

  • Permission for Construction in High-Elevation & Foothill Areas
    Areas exceeding 80-140 meters above sea level and foothill zones are now permitted to have single houses and standalone buildings, provided they comply with the standards of the Department of Public Works and Town & Country Planning.

  • Prohibition of Harmful Activities
    Strict regulations prohibit any activities that could pose risks to the ecosystem or cause environmental damage.

  • Changes in Hotel and Residential Building Regulations

    • The number of rooms in hotels, residential buildings, and condominiums that must comply with the new regulations has increased:

      • Previously: 10-29 rooms → Now: 11-49 rooms

      • Projects requiring an Environmental Impact Assessment (EIA):

        • Previously: 30-79 rooms → Now: 50-79 rooms

    • This relaxation aims to support small business operators.

Effective Date

The new regulations will take effect on December 14, 2024, and remain in force for five years.
