Increasing Foreign Investments in Thai Real Estate

Recently, there has been a surge in property purchases in Thailand by foreigners and expats. Many real estate agents frequently ask about the necessary documents for these transactions. To clarify, here is a complete list:

Documents Required for Foreign Buyers

When foreigners wish to buy property in Thailand, they must prepare the following documents:

  1. Passport

  2. Visa for entry into Thailand

  3. Work Permit (if applicable)

  4. Proof of income (Payment Slip)

  5. Bank statement or financial records:

    • Recent bank statement

    • Income Tax Payment receipt

    • Non-Resident Withholding Tax Certificate

  6. Foreign Exchange Transaction (FET) Certificate if money is transferred from overseas (obtainable from the bank)

  7. Property details related to the mortgage or financing application

  8. Contact information of the buyer and a close contact person (mainly a phone number)

Documents for the Sales Contract

  1. Sales and Purchase Agreement

  2. Deposit agreement or proof of down payment

  3. Photographs of the property

  4. Copy of the land title deed

  5. Copy of the property’s house registration

Condominiums:

Foreigners can buy condos under their name but must check the available Foreign Quota (FQ) with the condominium’s juristic office. The maximum FQ allocation is 49% of total ownership.

Houses and Land:

Foreigners can only purchase land through a Thai-registered company where at least 51% of the shares are Thai-owned. The company should be:

  • Established for over 3 years

  • Regularly filing financial statements and tax returns

For high-value properties, the company’s registered capital and financial records should reflect the value of the purchased asset.

If Married to a Thai Citizen

Additional documents are required:

  1. Original Spouse’s Consent Letter (two copies)

  2. Copy of Marriage Certificate

  3. Copy of Spouse’s National ID or Passport (two copies)

  4. Copy of latest stamped Immigration entry page (two copies)

If any documents are in a foreign language (even English), they may require translation by a certified translation agency with an official seal.
